国家最高检察机关侦查职能比较研究

摘　　要：尽管大陆法系国家和英美法系国家侦查权配置的模式不同,普通检察机关不一定侦查犯罪,但对于国家最高检察机关而言,则都履行侦查职能。英国皇家总检察署的严重欺诈局直接负责立案侦查重大欺诈案件和职务犯罪案件,美国司法部的联邦调查局负责反间谍侦查和对违反联邦法律的重大刑事案件侦查,德国联邦总检察院负责对危害国家安全的刑事犯罪和违法行为进行侦查,法国驻最高法院检察院的侦查职责与驻基层法院检察院的侦查职责基本一致,中国最高人民检察院具有全国性重大职务犯罪及渎职侵权侦查职责。国家最高检察机关的侦查职责具有法律监督的的属性和功能。中国最高人民检察院在侦查监督中应引入"提前介入"程序。The civil law countries and common law countries have different configuration modes of investigation power. Ordinary prosecutors may not detect crimes, but the country＇s highest Procuratorate must fulfill investigation functions. The Serious Fraud Office of the British Royal General Prosecutor＇s Department is directly responsible for the investigation of major fraud cases and cases of job related crimes. The Federal Bureau of Investigation of the US Judicial Department is responsible for anti-spyware detection and for violations of federal law and the investigation of major criminal cases. The German Federal Attorney General＇s Office is responsible for investigations about harmful criminal offenses and violations of national security. The French Procuratorate in the Supreme Court has the investigation duties basically identical with the responsibilities of the grass roots investigation of the court＇s Procuratorate. China＇s Supreme People＇s Procuratorate has a major duty of investigation of nationwide crime and malfeasance duties. Detection of the highest duties of the prosecution has the properties and functions of the legal supervision. In the practice of investigation and supervision of China＇s Supreme People＇s Procuratorate the procedure of ＂early intervention＂ must be introduced.
