美国国防领域对外商直接投资的产业战略探微及其启示

摘　　要：引进外资是各国经济建设中的一个重要环节。对外资的规范和监管,尤其是对涉及到国家产业安全战略等重要领域的外资监管,更不容忽视。文章对美国开放的产业投资政策的由来和演变进行了梳理,在探析美国竞争性产业的产业投资政策的基础上,分别从美国国防工业安全纲领、外商投资调查法以及备案管理和行业管理相结合的三大调控指导框架层面,解构了美国国防领域对外商直接投资的产业安全战略及其监管模式。文章同时剖析了与我国产业安全战略相关的外商投资政策问题,对我国的经济安全和产业安全政策及其监管体系提出了5个方面的建议。Foreign capital plays a very important role in national economic construction. However, monitoring and control ling on foreign capital,especially invested in defense industry , also couldn＇t be ignored. This paper deconstructs industrial policy and measures aimed to regulate foreign capital in the United States defense area, also explores their legislative backgrounds and headstreams. Meanwhile, great importance is emphasized to be attached to our industrial protection pollcy, and we must take corresponding legislative measures to industrial security due to the excessive growth of current for eign direct investment. The paper lastly offers preliminary suggestion about our own monitoring and regulating system to foreign capital.
