摘　　要：指出垫资进行工程承包是我国建设工程施工领域的普遍现象,从垫资承包的含义、表现形式,垫资承包的分歧观点,垫资承包的效力认定经历的三个发展阶段等方面阐述了对建设工程承包合同垫资承包的法律认识,从而避免可能导致的风险。The paper points out the contracting with funds is a common phenomenon in China s architectural engineering,indicates the lawful cognition of contracting with funds in architectural engineering,from the concept of the contracting with funds,the manifestations,the controversial points for the contracting of funds,and its effects,so as to avoid the potential risks.
