我国立法对公立医疗机构定位问题的探讨

摘　　要：2007年12月26日,卫生部部长陈竺向全国人大常委会作了关于城乡医疗卫生体制改革的报告,这标志着新一轮的医疗机构改革即将拉开序幕。公立医疗机构是改革的重中之重,面对改革有一些基本的理论问题是无法回避的,比如应如何在立法上对公立医疗机构进行定位,我国现有立法的定位有何不足,应如何完善?这些问题笔者作了研究与探讨。On December 26,2007,secretary of health ministry Chen Zhu has reported to the Committee of the National People＇s Congress about the city and countryside health organizational reform,this symbolized that a new round of Medical Institutes reforms would raise in our country.Besides,the Public based Medical Institutions is the most important part in the reform.Furthermore,There are some inevitable basic the- ory problems,for instance,how to locate the public based medical institutes in the legislation？ What＇ s insufficiency of the public based medical institutes positioning of legislation in our country？ How should consummate the positioning of legislation？ These above questions are studied and discussed in this research.
