论超生子女是否享有农村土地征收补偿费用资格

摘　　要：超生子女是否享有土地征收补偿费的判断标准在于其是否属于村集体经济组织成员。在一村集体经济组织中,任何新成员的加入都应当有正当理由。超生子女在其父母交纳了社会抚养费时开始,取得与正常出生的子女相同的村集体经济组织成员资格。超生子女在征地补偿安置方案确定前办理了该村户口登记的能享有相应的安置补助费份额;在村集体经济组织分配方案确定前其父母交纳了社会抚养费或办理了该村户口登记的有权获得相应的土地补偿费份额。Whether the unplanned born child has the qualification to acquire compensation for collecting countryside＇s land depends on whether he/she belongs In collective economic organization of countryside. In every, collective economic organization of countryside, the reason of affiliation of any new member should be legitimate. When his/her parents hand in social aliment, the unplanned born child acquire the same membership qualification of collective economic organization as other planned born children. Before land - collecting compensation management plan is confirmed, the unplanned born child who has registered in household should have corresponding management subsidy, and before allotment plan of collective economic organization of countryside is confirmed, the unplanned born child who has registered in household or whose parents have handed in social aliment should have corresponding compensation fur land loss.
