非传统安全背景下的海外中国公民保护问题初探

摘　　要：海外中国公民的权利保护是中国和平与发展中的一个重大问题。在海外的中国公民接受所在国的属地管辖,其权益受到侵害后首先应寻求当地救济。而中国作为国籍国有权对其进行外交和领事保护。外交保护由一国的国际不法行为引起,其行使具有一定的条件。领事保护是外交使领馆协助本国公民保护其合法权益的行为。在非传统安全背景下,我国应进一步加强领事保护制度建设。加强海外中国公民的外交与领事保护是"外交为国"向"外交为民"转变的重要标志。To protect Chinese citizens overseas is an important issue in the process of China＇s peaceful development. The Chinese citizens overseas are under the territorial jurisdiction of countries they dwell in. When their fights are violated, they have to first seek local remedies. As their native country, China is entitled to carry on the rights of diplomatic protection and consular protection for Chinese citizens overseas. Diplomatic protection is caused by the international wrongful acts of other countries. Certain conditions are needed to exercise diplomatic protection. Consular protection is an action of the consulates and embassies of the native country to protect the legitimate rights and interests of the native citizens overseas. Under the non-traditional security background China will strengthen the system establishment of consular protection and strive to transform from ＂the nation-oriented diplomacy＂ into a style of＂the nation-and-citizen-oriented diplomacy＂.
