专利创新高度及其发展趋势与影响研究——以美国KSR vs. eleflex案为背景

摘　　要：创新高度要求,决定于创造性的具体审查环节,什么情况下多个文献中的技术内容可以结合、如何结合,已经成为直接影响创新高度的关键因素.若本领域技术人员被赋予组合或改进对比文献的能力,可以根据存在于文献固有内容中的启示或者教导,将两个或者多个对比文献结合,那么这样的创新高度要求较高.有学者提出"如若不然"等新思路以代替目前的"非显而易见"思路,这将提高创新高度要求,减少改进型专利与防御型专利,重点保护不确定性较大的创新,对我国产生积极影响.The requirement of patent innovation height （PIH） determines the specific operational tache in the creativity examination. Under what circumstances the technical content in a number of documents can be combined and how to integrate them become the key factor that has direct impact on PIH. If the general technicians in the filed have been given the power to combine or improve the comparative literature, and two or more compared literatures can be combined according to enlightenments or teachings existing in the inherent content of literature, patent innovation height has higher requirement. Some scholars put forward the new idea of ＂otherwise＂ to replace the current ＂non-obviousness＂, which will increase PIH requirement to a high degree, so it has a positive influence on China by reducing the improved patent and defense patent while giving more protection to the innovation with more uncertainty.
