中美职业体育产业垄断性质之考量

摘　　要：从垄断的基本认识入手,阐述了职业体育产业垄断的基本性质。认为职业体育产业不单是一种典型的运动卡特尔,还更兼具一定的自然垄断与行政垄断属性;与美国职业体育产业垄断相比,现阶段我国职业体育产业更主要表现出来的是转轨国家所特有的体制性行政垄断,其存在的基础主要是行政权力,其实施的范围往往大大超出了市场失灵的边界。Beginning with the understanding of monopoly, the author analyzed the fundamental nature of monopoly in professional sports industry, and thought it is not only a typical kind of sports cartel, but also has some eertain natural and administrative monopolies. Compared with the monopoly in American professional sports industry, the one in our country sports industry, nowadays, nainly displays the institutional administrative monopoly, which is an unique attribute in switching countries, and it＇s existing basis is mainly the administrative authorities, it＇s implemented scope often has greatly surpassed the boundary of market malfunction.
