论经济区域内行政立法一体化及其路径选择

摘　　要：随着国内区域经济一体化的深入发展,分割式的地方行政立法现状已成为一体化的障碍。为克服这种矛盾,区域行政立法必然也要一体化。应构建一种紧密型的地方行政立法协作模式——"区域共同规章",即在一定的经济区域内,对相同或近似的行政立法事项实行共同立法,并能在一定经济区域各行政区划内统一适用。目前,区域共同规章的构建还存在不少法律上的障碍,应通过修改立法法和相关法律条款的方式,明确区域共同规章的合法性、制定的主体、可协作的权限和范围,解决其法律效力等级问题,确定立法的基本指导原则等。With the further development of regional economic integration, the isolated local administration and legislation has become the obstacle of the integration. In order to overcome the problem, the local administration and legislation should be integrated. A close joint mode of local administration and legislation ＂Regional Common Regulations＂ is proposed to set up. Presently, the construction of ＂Regional Common Regulations＂ has quite a lot legal barriers. Through revising the law of legislation and relevant legal provisions, certify the lawfulness of ＂Regional Common Regulations＂, its subject and its permissions, solve the class problem of its legal effect and establish its guidelines.
