摘　　要：村民自治是海峡西岸新农村建设的制度基础和重要保障。村委会选举制度是新农村建设中村民自治运行机制的基本制度,也是学界关注的焦点。尽管村委会换届选举一届比一届成功,但在选举过程中,仍存在着许多尚待解决的法律问题。为此,必须完善与村委会选举有关的实体法律;修改和完善村委会选举制度的有关程序;建立和完善村委会选举的保障救济机制。The village committee is a new electoral system the autonomy of villagers in rural areas the construction of the basic system operating mechanism as well as the academic focus.Although the village the next general eleetion than a successful,but in the electoral process,there are still eligible voters found difficult,difficult to define the eligibility of candidates,the number of the villagers to run the ＂double-half＂ difficult to rule out the clan,sectarian forces difficult interference,vote-buying behavior difficult to define,difficuh to investigate and deal with vote-buying behavior,difficult to guard voting by proxy,the mobile ba｜lot boxes for the management of difficult,hard to start the recall process,such as legal issues.Therefore,we must improve and the village committee eleetion-related legal entities;modify and improve the electoral system of the village committee procedures;the establishment and improvement of the protection of the village committee election relief mechanism.
