摘　　要：自然灾害发生后,只有在灾害发生国同意且发出请求的情况下,其他国家或政府间国际组织的救援队伍及其人员方可入境实施救援,现行国际法尚未将"保护的责任"适用于自然灾害。在灾害国际救助领域,现行国际法已经涵盖国际灾害救援队伍及其人员入境、特权与豁免、索赔与诉讼等。我国需要借鉴国际法,建立国际灾害救援规则。After natural disaster occurred,disaster relief or initial recovery assistance from other countries or international-governmen- tal organizations should be initiated only with the express consent of the affected State and in principle,on the basis of an appeal. linder existing international rules,＂responsibility of protect＂ have not applied to natural disaster.ln the field of international disaster relief,international rules have already covered the international disaster relief team and its personnel,privilege and immunity ,claims for compensation.h was necessary for China to establish the rules on international disaster aid, considering the existing international rules.
