论我国案例指导制度的构建

摘　　要：建立和完善案例指导制度是一项重大司法改革措施。本文从现行司法审判实践中存在的"同案不同判"问题入手分析构建案例指导制度的必要性,从现行我国的法制基础和实践经验角度阐述制度构建的可行性。建议确立"以事实为依据,以法律为准绳,以案例为指导"的司法审判原则,赋予指导性案例约束力;分别确立指导性案例的选编和公布主体。并就指导性案例的选编标准、程序、适用以及保障案例指导制度的相关激励和约束机制提出建设性意见。Establishing and perfecting case guidance mechanism in China is a significant innovative legal reform. This article analyzes the necessity of constructing case guidance mechanism via the ＂same case with different judgment＂ in the judicatural practice. It argues the possibility through the legal base and the practicing experience and suggests establishing the legal judgment principle of ＂basing on facts, taking law as the criteria, and case as a guide＂ hence to give sanction to case guidance. Recommendations are to establish guidance and publishing case subjects. And suggestions concerned with a selection of cases on the guiding standards, procedures, and application of the guidance system and the protection of the related case of incentive and constraint mechanism for constructive comments.
