论夫妻同居义务——空床费事件引发的思考

摘　　要："空床费"一案在社会上引起了极大的轰动,引发了学界对夫妻同居义务的探讨。同居是男女双方缔结婚姻的应有之意,婚姻本身就是男女双方以共同生活为目的的结合。法律只需要对诸如重婚、家庭暴力、遗弃等侵犯他人权益、危害社会的行为加以严惩,法律应止步于卧室之外,对于同居义务,法律不宜做硬性的规定,完全属于夫妻意思自治的空间范畴。The case ＂empty-bed fee＂ had caused a great sensation in the society, which led scholars to discuss the obligation of cohabiting couples. Cohabitation is contained in a marriage when the couples married, and marriage is a combination of men and women who want to live together. The law only needs to severely punish the behaviors which infringe upon others rights and interests, or which is harmful to society, such as bigamy, family violence, abandon. Law should stop outside the bedroom. Law is inadvisable to do a mandatory provision to the cohabiting obligation, because it is up to the couples totally.
