摘 要:突破传统的民商法范式,从行政权力的视角,开展房地产登记制度的研究,适应了深化行政管理体制改革的现实需要。从行政权力的视角看,我国房地产登记制度面临三重困境,即观念层面的官本位、体制层面的改革不彻底、制度层面的法治不完备。改革完善我国房地产登记制度可以从以下方面着力:树立服务理念,理顺权力与权利的关系,统一登记制度,强化法治监督,完善权利救济。To research the registration system for real estate, from the aspect of administrative authority, which breaks the traditional method of civil and commercial law, meets the practical needs of deepening the reform of administrative system. From the aspect of administrative authority, there are three problems in China's registration system for real estate:officerbased concept,incomplete reform and legal system at the system level. To improve the registration system,we need to focus on the following aspects of work:establishing the concept of service to public in all things,straightening out the relationships between power and right, unifying the registration system,intensifying legal supervision and improving the remedy system.
