中国有组织犯罪相关概念特征的重新审视

摘　　要：有组织犯罪应包括有组织行为的共同犯罪、共同犯罪中的聚众犯罪、集团犯罪、黑社会性质组织犯罪、黑社会犯罪及其他根据其具体行为的具体内容确定的犯罪组织所实施的犯罪、洗钱罪等;立法解释对"黑社会性质的组织"的特征作出了统一归纳;完善中国对有组织犯罪的惩治和预防对策包括修改和完善相关立法、建立职能化、专业化和效能化的反有组织犯罪的专门机构、实施特别证据制度、建立情报预警机制等。The organized crime in Chinese criminal law includes organized joint crime, assembled crime included in the joint crime, group crime, underworld-natured crime, underworld crime and other crimes defined according to their particular criminal behavior included in the organized crime, and money laundering crime, etc, and legislative interpretation in 2002 fixed the characteristics of the ＂ underworld-natured organizations＂. Measures improving the organized crimes punishment and prevention may include revising and ameliorating relevant laws, establishing a functionalized, professionalized and efficient specialized agency against the organized crime, implementing especial rule of evidence, and creating intelligence forewarning mechanism, etc.
