80年代与90年代司法精神病学鉴定案例的对照研究

摘　　要：目的探讨近年来司法精神病学鉴定的特点和发展趋势。方法对９０年代经该院鉴定的１１９例与８０年代鉴定的４７例案例进行对照研究。结果与８０年代组比较，９０年代组的未婚比例、既往精神病史较多；案件类型以凶杀、伤害升至首位（３７．８％），经济案件明显增多（８．４％）；鉴定诊断两年代组均以精神分裂症占首位（３１．９％），９０年代组拘禁性精神病和脑器质性精神障碍明显增多（９．２％）；部分责任能力比例（２７．３％）和服刑或受审能力鉴定（１７．６％）亦增加。结论两个年代司法精神病学鉴定的特点有所不同。Objective The paper was to explore the characteristics and tendency of forensic psychiatric expertise in recent years. Methods A comparative study was conducted between 47 cases in the 80s and 119 cases in the 90s. Results There were more unmarried cases and those with history of psychosis or other mental disorders in the 90s group.The cases of killing or injuring were listed the first (37.8%).The number of cases associated with finance was increased considerably. In expertise diagnosis,31.9% of the cases were schizophrenics in 1990s,and detention psychosis appeared to increase significantly as compared with those in the 80s. The ratio of cases with partial responsible ability and ones with the abilities of serving a sentence and submitting penalty was also increased in 1990s ( P <0.05). Conclusion Some of the characteristics of forensic psychiatrics expertise are different between the1980s and 1990s.The expertise of responsible ability tends to be more rational in 90s.
