摘　　要：对产品质保条款进行经济分析的目的,旨在揭示什么样的质保条款架构是有效率的。工产品销售的质量保证,一直都是由生产者通过格式合同的形式单方规定的。为公正的在生产者和消费者之间分配产品质量担保责任,立法和法院需要在不同的法律规则之间适当选择。The puupose for making an economic analysis of product quality protection clause is to reveal what kind of quality protection clause can work efficiently. The product guarantee in the sale of the industrial product is always formed unilaterally by way of format contract by the producer. For the purpose of allocating product quality liability between the producer and the consumer, both the legislature and the court should make a sound selection between various rules and regulations.
