国际金融危机语境下的中国资本市场法制改革

摘　　要：由美国次贷危机所引发的全球金融危机已经重创世界各国经济,其不利影响仍然在向纵深方向发展。中国的资本市场自改革开放以来已经存续了近二十年,其间也发生了很多金融风波和震荡,既有经验,也有教训。而在此次的全球金融风暴中,尽管我国经济受到的影响相对缓和,但是进行金融市场的法制改革要求已经迫在眉睫。我们要建立对金融市场进行全面监管的制度体系,要正确处理好中国金融监管和金融创新之间的关系,要在金融现代化的条件下,制定符合市场理念的现代金融法制体系。这要求我们不仅要立足中国现实,同时更要借鉴国外资本市场法制建设的成功经验。其核心在于中国资本市场要符合市场经济的理念,要建立新型的市场创新体制,尤其是市场交易制度的改革创新。The global financial crises caused by American Subprime Mortgage Crises has inflicted heavy losses on the economy of most countries in the world and it still has a detrimental influences in a deeper way. The capital market of China has existed for twenty years since the reform and opening to the outside world. During this period, we have got both experience and lessons from the banking crises and shocks. In this global financial storm, the capital market of China is impacted relatively in a moderate degree, but the situation necessitates urgently our legal reform of the financial market： we must construct the overall supervision system of the financial market, handle the relationship of financial supervision and innovation in a sophisticated manner, and formulate the modern financial legal system which is in accordance with market conception under the situation of financial modernization. This is in the need both of basing ourselves on the reality of China and using the successful experience of the construction of foreign countries＂ capital market for reference. The core is that the capital market of China should be in keeping with the concept of market economy and build the new type of market innovation system, especially in the matter of the reform and innovation of market transaction system.
