保险合同成立与生效的法律研究——对2009版《保险法》的学习与思考

摘　　要：新修改的《保险法》在关于保险合同成立与生效方面有些改动。通过对相关法条的学习与思考结合保险合同成立与生效的基本理论以及容易引起纠纷的相关问题,本文从保险合同成立与生效的标志,保险费、预交费用的交付以及保险合同订立过程中的特殊责任等方面提出了一些建议。The newly revised ＂Insurance Law＂ takes some changes on the establishment of the insurance contract and the entry into force of the insurance contract. With learning and thinking of these relevant legal provisions, the basic theories of the establishment of the insura ~ce contract and the entry into force of the insur- ance contract as well as the issues easily lead to disputes, this article gives some suggestions on the sign of the establishment of the insurance contract and the entry into force of the insurance contract , the insurance premium, the delivery of prepaid expenses and the special responsibility during the process of concluding the insurance contract.
