摘　　要：宽严相济的刑事政策是我国在惩办与宽大相结合、严厉打击刑事犯罪的刑事政策基础之上产生的新刑事政策，也是当前打击犯罪、应对犯罪策略的理性选择。作为一项新的刑事政策，有其基本的内涵和存在的必要性，但在适用过程中也存在一些问题，本文着重分析其现状及问题产生的原因，并试图寻找解决对策。The less favorable economic phase of the criminal policy is China＇s combining punishment with leniency to crack down on criminal offenses based on criminal policy have created a new criminal policy, but also the current fight against crime, deal with crime, rational choice strategy. As a new criminal policy, the basic need for meaning and existence, but in application there are some problems, this paper focused on analysis of their present situation and the causes and try to find a solution measures.
