摘　　要：军事刑法在国家刑罚体系和军事法体系中占有重要地位,作为其核心内容的军事犯罪,在我国的立法与司法实践中还存在诸多不足。解决这些问题有利于为建构军事犯罪体系乃至军事刑法体系提供一个理论基点。Military crime law is an important part of the national criminal law system and military law system. There are so many deficiencies in the judicial practice and legislation of Military crime which is the key content of military crime law. The problems should be solved. It is good for building up the theory base point of military crime system and military crime law system.
