摘　　要：城市居民委员会与业主委员会在商品房住宅小区中并存已经引起相当多的冲突与摩擦,针对二者的关系,理论界和实务部门已经提出诸多观点。目前法律和实践中的居委会是一种强制性、全能型的组织,与现代中国社会日益疏离,再保持二者并存的局面,进行"保守治疗",已无法适应我国社区自治和市民社会的发展。The coexistence of city residents＇committee and proprietors＇committee in marketable residential district has caused many conflicts. People in academic and practical departments have given many opinions. The author believes that the residents＇ committee in Chinese law in force and also in practice, being compulsory and all-round, conflicts with modern Chinese society. Maintaining of the coexistence of the two and conservative treatment cannot adapt to the development of community self-governing and civil society in China.
