摘　　要：在著作权纠纷案件中,视频分享网站通常认为自己履行了"通知+移除"程序即可免除侵权责任,这是对"避风港"规则的误读。"明知或应知"是判断其是否侵权的关键,这就要求视频分享网站承担起合理注意的义务,担当"善良管理人"角色,不能放任侵权视频作品在网站上传播。Many video sharing websites in China misunderstand the rule of ＂safe harbor＂. In their opinion, they could be free of infringement if they have conducted the procedure of ＂notice-take down＂. The article proposes that it is the key criterion of infringement judgment that whether websites ＂have already known or should know＂. Thus it is neces- sary for websites to act as an ＂honest manager＂ to reject infringing videos.
