摘 要:专项物业维修资金制度是我国物业法律制度的重要组成部分,该制度的建立和运作尚处于初级阶段,需要随着实践的发展而不断发展和完善。专项物业维修资金制度的核心内容就是资金的归集和使用等,既涉及业主之间的复杂的权益平衡问题,又涉及政府在社会公共问题上的治理以及与私人自治权益协调平衡的问题。因此,专项物业维修资金制度要进一步发展完善,以引导规范和平衡协调各方的权益关系等。同时,专项物业维修资金制度需要充分考虑风险社会的各种特殊情形,建立相应的风险预防和应对的制度规范。Maintenance fund system on special item, as an important part of real estate legal system in China, is in its primary phase of development and calls for further improvement. The core content of maintenance fund system is the collection and employment of funds, which relates to the balance of rights and interests between owners of real estate, involves good governance in the field of the public good and accordingly necessary balance between public administration and private autonomy. Therefore, maintenance fund system on special item should further be amended so as to regulate and harmonize rights and interests in every aspect. All kinds of special condition in risk society should be considered so that risk prevention and management norm can be constructed in maintenance fund system.
