“人肉搜索”与个人信息安全问题刍议

摘　　要："人肉搜索"作为后起的新兴的网络技术手段,对网络信息安全的影响很大,尤其是对个人信息安全构成了巨大的威胁。尽管"人肉搜索"具有一定的积极意义,但同时也存在严重的侵权问题,其主要原因是网络自身的特性、我国网民素质不高、网络基础管理不到位和立法滞后等。应针对上述问题,积极寻求解决的对策,在切实保障个人信息安全的前提下发挥"人肉搜索"的证明作用。Manpower search, as a newly-emerging network technological means, has greatly influenced network information security, and seriously imperiled personal information security in particular. Though manpower search plays a certain positive role in some ways, meanwhile, it evokes the problem of severe right-infringement because of those major factors： the characteristics of network itself, the ill qualities of Chinese netizens, the real-management of network foundation and the lagging legislation. Therefore, it is advised to seek for countermeasures with efforts aiming at the above-mentioned problems, and give full play to manpower search＇s proof function on the premise of solidly safeguarding personal information security.
