汉代家庭继承制度的社会史考察

摘　　要：汉代家庭的形态无疑与家庭继承制度有很大关系。在诸子均分家产的继承制度下,汉代形成了以个体小家庭为主的社会结构,也存在一定数量的与父母或未成年弟妹"同居"的家庭,已婚兄弟同居及数世同居的大家庭为数极少。争讼与让财是汉代家产继承中两种相对的现象。宗族亲戚和乡里在家产继承事务中起重要作用。在家庭财产继承关系上,公权力的干预让位给了乡里的调整,从这个意义上说,汉代社会是一个乡里社会。在家庭继承关系上,汉代家庭女性虽具有一定的继承权,但女性的继承权还是受到限制。宗祧继承的观念对汉代家庭继承关系造成了重大的影响。This paper investigates people＇ s daily behavior modes such as family structure, behaviour in the family inheritance, relationship between sex and inheritance rights, concepts affecting inheritance and so on in the Han Dynasty from the perspective of social history. Inevitably, the family structure in the Han Dynasty is closely related to family inheritance system. In the inheritance system of sons＇ sharing the property, the nuclear families become the main social structure in the Hart Dynasty. At the same time, there also exist a limited number of extended families. Contesting a lawsuit and yielding property are opposite phenomena in the family inheritance in the Han Dynasty, while the family clan and neighbours play an important role in the family inheritance affairs. In other words, the government＇ s intervention gives way to neighbours＇ adjustment. Therefore, to some extent it is a neighbour society in the Han Dynasty. In the aspect of family inheritance relationship, the female members enjoy certain but restricted inheritance rights. In a word, the inheritance concept of family clan has a great influence on the family inheritance system in the Han Dynasty.
