摘 要:我国工资等劳动债权案件优先执行存在诸多问题。现行立法对工资等劳动债权的规定既不系统,又较为混乱,甚至相互冲突,故而工资等劳动债权案件优先执行难以施行;同时司法实践中对工资等劳动债权不加限制的优先受偿,易造成负面影响,损害多方利益。解决问题的方法是,一方面要全面提升工资等劳动债权优先执行的法律地位,另一方面要对其进行必要限制,实现二者的辩证统一。There are many problems in Chinese executive priority of wages and other labor claims. The provisions of wages and other labor claims of existing legislation are not only unsystematic, but also confusied and even conflict with each other,therefore,they hardly be carried out. At the same time, in the judicial practice,the priority for repayment of the wages and other labor claims without restriction may easily lead to negative impacts harming the multi - party interests. To solve these problems,on the one hand,we should comprehensive upgrade the legal status of executive priority of wages and other labor claims. On the other hand,we should restric them to achieve the dialectical unification.
