摘　　要：侵犯商业秘密罪被纳入我国刑法10余年,对权利人的商业秘密进行了有力的保护。但我国刑法对其规定却表现出一种"厉而不严"的罪刑结构,在当前刑法向"严而不厉"发展的背景下,我们需要对该罪的罪刑结构进行深入分析,针对其结构特点提出相关的完善建议,以使其更好地实现社会保护和人权保障功能。The Crime of Violation of Trade Secrets has been included in China s Criminal Law for 10 years and has strongly protected the trade rights of owners.However,the provision of our Criminal Law is harsh but not strict.As the Criminal Law tends to become strict but not harsh,we need to analyze their current criminal structure and give suggestions to perfect the structure to fulfill the function of protecting society and human rights.
