对农村空置宅基地管理的法律制度思考

摘　　要：农村宅基地属于农村建设用地的一部分。目前,中国农村存在相当一部分空置宅基地,这些宅基地的合理规划、利用关系到国家节约用地目标的实现和农村治安状况的改善。在分析现有农村空置宅基地实况及引发的社会问题的基础上,对农村空置宅基地管理法律制度作出几点思考:一是对农村"空置宅基地"作出明确的司法解释,确立空置权;二是完善农村空置宅基地国家法律制度;三是制定合理的农村空置宅基地配套法律制度措施;四是完善农村空置宅基地的收回的执法与监督制度。The house sites in the country are parts of construction lands. At present, plenty of house sites are not in use in Chinese country. Making good use of the lands is important for fulfilling the goal of optimal land utilization and for improving the security condition in the countryside. This paper proposed some suggestions on how to manage these idle lands. First, a clear judicial interpretation should be made for the idle lands＇. Secondly, the legal system for the idle land should be perfected. Thirdly, relevant supporting policies should be established to implement the law effectively. Finally, law enforcement should be strengthened to improve the reclamation and the supervision system.
