代议抑或参与——当前我国公众参与立法的不足与对策研究

摘　　要：公众参与是当前我国政治社会生活中的热门话题,无论公众还是国家机关都对其寄予了厚望。然而在实践中却存在着夸大其积极意义和作用、忽视其缺陷的倾向。从西方的理论和经验以及我国公众参与立法的实践经验可以发现,公众参与作为直接民主的一种表现形式具有先天的缺陷和不足。因此,应当完善人民代表大会制度,将公众参与充分制度化,以真正发挥公众参与的积极作用。Public participation is popular in our political life; however, the current tendency is to exaggerate its positive function while ignoring its defect. Analyzing from the western theory and experiences, and our own praetice, it is obvious that public participation, a form of direct democracy, is born with flaws. Therefore, to perfect People＇s Congress System and fully institutionalize public participation is the right way to put it into full play.
