摘 要:非洲法律文化在长期的变迁转型过程中,荟萃了本土习惯法、宗教法、近现代西方大陆法和英美法,多样法源相融共存,展示出一幅法律发展的多彩画卷。非洲法的历史,主要是非洲习惯法、伊斯兰教法与西方法相互排斥、相互融合的历史。在非洲,"本土法"和"外来法",是个相对的概念。真正意义上的本土法是所谓"祖先法",它是与非洲的原始宗教相连的习惯法;而伊斯兰法经过长期本土化和民族化后最终演化为非洲的本土法,并与新的外来法——西方法对立。作为非洲的第二波外来法,西方法与非洲固有法和伊斯兰法发生着对抗和融合,但它最终又成为非洲最具立法意义的法。本土法与外来法的冲突与融合、相融与并存的错综复杂关系一直是非洲法律发展的主旋律。In the long process of transformation, Africa legal culture assembled the local customary law, religious law, modem western civil law and common law. All of these blending diverse coexisting sources, made the Africa legal culture a colorful picture. The history of Africa law is mainly the reciprocal exclusive and integrative history among the Africa customary law, Islamic law and Western law. In Africa, both the "native law'and the "foreign law'are relative concepts. The real native law is a so-called "ancient law ", which is a customary law related with the Africa religion. The Islamic law, over a long evolution of localization and nationalization, eventually evolved into the native law, becoming confrontation with the new coming foreign law-western law. As Africa's sec- ond foreign law, the Western law conflicted and also integrated with the African indigenous law and Islamic law, but it eventually became the law of most legislative significance in Africa. The complicated relationship between native law and foreign law, which including conflict, integration, blending, co-exlstence, has been always the main melody of the legal development in Africa.
