景区景点的著作权保护不容忽视——评摄影师状告龙门石窟管理局侵权案

摘　　要：龙门文化旅游园区管理委员会(原名龙门石窟文物保护区龙门风景名胜区管理局)在《大河报》发布"夜游龙门"广告时,未经同意使用了摄影师的图片,摄影师将龙门石窟及大河报社告上法庭,要求赔偿。龙门石窟文物保护区龙门风景名胜区管理局反诉摄影师侵权,反诉的理由是摄影师违反了文物保护法。反诉被法院驳回。案后冷静思考,摄影师的拍摄是建立在龙门石窟修缮和布置夜景的基础之上,没有"夜游龙门"的创意及灯光设计布景,摄影师就不可能拍摄出本案中的照片。龙门石窟管理者应该具有某种权利——景区景点的著作权。The Management Committee of the Culture and Tourism Park of the Longmen （The Original Name is the Longmen Scenic Area Authority of the Conservation Area of the Longmen Grottoes） used four pictures from Photographer Zhang Xiao-li and didn＇t get the photographer＇s permission when the authority advertised the topic of ＂visiting Longmen at night＂ in the ＂Dahe＂, so that the photographer charged the Longmen Grottoes and ＂Dahe＇with infringement and required for compensation. The Longmen Scenic Area Authority of the Conservation Area of the Longmen Grottoes counterclaimed the photographer＇s infringement because the photographer violated Cultural Relics Protection Law and the court turned down the counterclaim . Thinking it over calmly after the case ,the photographer＇s shooting was based on the Longmen Grottoes＇ repairing and arranging night scene ,without the idea of ＂visiting Longmen at night＂ and the design and scenery of light ,the photographer could not have taken the pictures in the case. The manager of the Longmen Grottoes should possess a kind of right-Copyright of Scenic Spots.
