摘　　要：我国现行刑法规定的遗弃罪具有一定局限性,在社会实践中存在着本应该受到刑罚处罚的遗弃行为而被排斥在刑法追踪视野之外的窘境。因此,填补法律空白,完善遗弃罪的规定对发挥刑法的法益保障机能、更好地保护弱势群体大有裨益。The crime of abandonment ruled by China＇s current criminal law has certain limitations. There are the awkward situations in social practice that these abandonment actions, which should be punished by criminal law, are excluded from criminal law field. Therefore, we should fill the legal gaps and improve the regulations about the abandonment crime to protect the vulnerable groups＇ benefit.
