海南黎族习惯法价值的法理学分析

摘　　要：黎族习惯法形成于黎族在千百年的生产、生活实践中,从黎族习惯法中不仅可以看到黎族人民对本民族社会内部、人类社会与自然生态和谐稳定的秩序价值的追求,其对待非婚生子女的态度以及"赔命价"制度凸显了其对效益价值的重视。同时,黎族习惯法中所蕴含的正义、民主价值从执行者的公正无私以及人民群众对审判活动的民主参与中得到了充分体现。Li nationality customary law came into being in Li nationality＇ s social production and daily life through hundreds of years. The law not only contains their pursuit for the order value of their inner community, and that of of harmony and stability between human being and natural eco-system. It also reflects Li nationality＇ s emphasis on the value of efficiency, which is highlighted by their attitude towards natural children and the custom of life-compensation price. Moreover, the law embodies the value of justice and democracy, obviously displayed by the impartiality of the law enforcers and by the democratic participation of the public in judicial activities.
