摘 要:在国外的学说和理论中,通常根据两个标准确定交通事故损害赔偿责任的主体:一是运行支配权;二是运行利益的归属。我国有关交通事故损害赔偿的立法中,未对交通事故损害赔偿的责任主体作出概括和界定,这给司法实践中人民法院判定损害赔偿责任主体带来一定困难。如何认定机动车交通事故赔偿责任主体,笔者认为应依据车辆实际支配管理、运行利益归属及有关法律特殊规定,其中以车辆实际支配管理和运行利益归属为原则性标准,以法律特殊规定为具体性标准。In the foreign doctrines and theories, often based on two criteria to determine the main body of traffic accident liability, First, control over the operation; Second is to run the interests of the attribution.
