摘　　要：融资租赁是一种兼有融物与融资目的,将贸易与金融紧密结合,在买卖与租赁的基础上发展起来的一种独立的商品交易。这种交易的法律形式是债权合同。融资租赁交易的法理基础是所有权分化理论。融资租赁债权合同具有物权属性,其内容是由三方交易及两个合同关系所复合而成。Finance lease is a kind of the new deal of goods which it is a kind of double financing and financial functions , it had bound trade and finance closely, and the development is in the foundation of buying and selling and charter party. The bargain is the form of law of the deal . The base of theory of law is the theory of separate of ownership. The bargain of finance lease has attribute of right of matter . The content is amalgamation which it is the deal of ternary party and a couple of connection.
