中西法官保障制度比较研究

摘　　要：文章通过对中西法官在任期、薪金、司法豁免、弹劾程序等保障制度方面的比较,提出了完善我国法官保障制度的相关建议:在任期方面,应适当延长专业水平较高的资深法官的退休年龄;在薪金方面,应在精简法官数量的基础上逐步提高法官待遇;在司法豁免方面,应明晰司法豁免权适用的条件和情形,建立较强意义上的法官司法豁免权制度;在弹劾(罢免)方面,从扩大法官罢免对象的范围、规定罢免法官的法定事由和罢免前的调查程序三个方面进一步完善我国现有的法官罢免制度。Judge secure system is necessary to judicial justice. The main content of western judge secure system includes lifelong tenure, plentiful salary, strong judicial immunity and firm impeachment procedure. In order to better achieve judicial justice, it is necessary for our country to learn from western＇s judge secure systems, for example further improvement can be made in three aspects： to raise gradually judges＇ salaries, to clarify the circumstances for immunity to jurisdiction of judges and to improve the judge recalling system.
