摘　　要：随着我国市场经济不断发展,人们的投资渠道出现多元化趋势,夫妻拥有的财产种类也越来越丰富,股权作为一种投资权益已悄然成为夫妻财产的新型代表。然而,随着离婚率的不断上升,离婚纠纷中涉及的公司股权争议也越来越多。文章从夫妻共有财产界定及公司股权的特性入手,探讨夫妻一方名下股权的归属并对我国相关法律提出完善建议。With development of market economy in our country, investment channels have shown a plural tendency. The couple have so many property types that the equity becomes a new＇represent of the couple＇s property as investment equity. However, while divorce rate is rising constantly, company equity dispute in divorce becomes more and more. Based on characteristics of the couple＇s community property definition and company equity, the paper discusses the reputation in equity owning by one of the couple, and puts forward some suggestions on the relevant laws in China.
