摘　　要：和谐是人类的共同社会理想。中国的传统法律文化尤其钟情于"和"的概念,无论在人与自然的关系上,还是在社会关系与政治关系方面,都力求达到和谐境界。然而当这种理念被付诸实践,所依靠的并不是社会主体的自觉,而是一种外在的强制。Harmony is not only the profound essence of human culture, but also the common ideal of human society. Chinese troditional legal culture especially prefers to ＂harmony＂, in the relationships between human and nature, or in the Social relationships and political relationships, harmony is the last goal. But the enforcement of this ideal depends on external obligation, not the initiative of social subjects.
