承运人无单放货保险人是否承担责任的探讨

摘　　要：针对承运人无单放货,在海运货物保险一切险的情况下保险人是否承担责任问题,分析我国国内典型案例和我国最高院的司法规定,从不同角度论述保险人应当承担责任的理由,提出保险人应当承担承运人无正本提单交付货物造成被保险人的损失,除非合同明文规定不承担责任。This paper focuses on the issues whether the insurer under All Risks is liable for releasing cargo without bill of lading by the carrier and analyses the leading cases as well as the regulation made by the Supreme People＇s Court.Its point out the reasons from different point of view that the insurer should bear the responsibility under the All Risks cover for carrier delivering the goods without the production of the original bill of lading,unless the contract expressly provides otherwise.
