北极群岛水域法律地位的历史性分析

摘　　要：由于各国对西北航道的权属争议日趋激烈,加拿大北极群岛水域的法律地位也一再成为北极争端中的国际热点。在这样的国际背景之下,美加等国围绕北极群岛水域是否属于加国的历史性内水提出各自的官方主张。根据理论上对历史性水域法律地位和成立标准的界定,综合考虑美加两国立场,通过对历史性水域理论在北极群岛水域的适用分析可知,将北极群岛水域看作是加国的历史性内水具有一定的理论基础和实际意义。As the dispute of ownership of the Northwest Passage is growing more and more intense, the legal status of the waters of the Canadian Arctic Archipelago has become an international hot issue in the Arctic dispute. In this international context, the United States and Canada and other countries have made their respective official claims as to whether the waters of the Canadian Arctic Archipelago belongs to the historic internal waters of Canada or not. In theory, considering both the definition of the legal status and the establishment of standards of the historic waters, and the positions of the United States and Canada, we can see that the waters of the Canadian Arctic Archipelago being the historic internal waters of Canada has some theoretical basis and practical significance after analyzing the application of the theory of historic waters in the Arctic waters.
