摘　　要：西方社会法制之成果,主要得益于法的形式正义的实施。然对其之讨论,往往局限于形而上,而乏联系具体制度的分析,以致长期只能沉溺于空谈,对国家法制发展少有裨益。故必以深具特色的、可代表西方精神的具体制度加以探讨,方得窥其精髓,以为我攻玉之石。The results of the rule of law in western societies, mainly benefits from the implementation of justice. However, their discussion is often confined to the meta -physical, and the lack of analysis of specific systems of contact, resulting in long-term can only indulge in empty talk, and few developments of the country benefit from the rule of law. Therefore, great features which represent the spirit of the west should be explored in the specific system, and then we get to see the essence for me to polish the jade stones.
