摘　　要：随着社会转型期的利益多元化和市民维权意识的高涨,听证活动正在成为城市规划管理过程中利益表达的重要途径和形式。在当前经济社会快速转型的背景下,如何通过规范的制度建设,推动听证制度各项目标的充分实现,避免听证活动成为符号化、走过场的公众参与形式或是无序的情绪宣泄渠道,仍是目前需要探讨的重要课题。试图在理论层面探讨规划管理听证制度的价值目标和程序规则等功能内涵的基础上,总结目前我国主要城市规划行政许可听证制度的建设状况,通过听证制度的文本分析找出制度建设的主要问题,探讨今后制度建设的方向和内容。Public hearing is an important method for interest groups to express their opinions and initiate bargaining activities in urban planning in the transitional society of China.It has great significance on the provision of opened platform for negotiation and consultation between government and other stakeholders.This paper aims to explore institutional function of public hearing in planning permit system by factor of democratic value and procedural rule,and review current condition of its institutional development in major cities.Finally,it demonstrates major problems in institution development based on literal analysis of ordinances and discusses possible countermeasures in existing legal framework.
