摘 要:文章结合立法资料,分析了现行著作权法对录音制品二次使用的法律规整。文章指出著作权法对广播组织和表演者及录音制品制作者的关系未作规定,乃是立法者从保护广播组织的法律政策出发,让广播组织就此不承担法律义务的一种有意安排,其并非法律漏洞,法官不得进行漏洞补充,必须严格依照立法者意志作出裁决。针对该项规整,文章批评了其立法技术缺陷带来的不合理结果,提出了修改建议。Referring to the legislative information of PRC Copyright Law,this paper analyses the regulation of secondary uses of phonograms in PRC Copyright Law, and points out the fact that no rules are made in the relationships between the broadcasting organizations and the performers and producers of phonograms in the secondary uses of phonograms should not be regarded as a legal leak, but an intentional arrangement of the legislators, who want to protect the broadcasting organizations against legal obligations to the performers and producers of phonograms in the secondary uses of phonograms. This article also criticizes the regulation of secondary uses of phonograms in PRC Copyright Law, and offers suggestions on the revision of PRC Copyright Law.
