摘　　要：强制拆迁在现实生活中纠纷较多的重要原因之一是没有正确处理好行政强制功能和司法强制功能的关系,对适用行政强制程序进行拆迁的权力使用过多过滥,因此常常会损害被拆迁人的利益。本文通过对行政强制拆迁法律特征的分析,提出行政强制拆迁的适用范围应当限制在公益性建设项目之内,并通过严格的条件和程序来规范,籍此来保护被拆迁人的合法权益。There are many disputes in coercion removing for the relationship between administrative and justice coercion function was not recognized correctly and excesstive coercion process will do harm to the relocated people＇s benefit. According to the analysis of law characteristics of administrative coercion removing, This paper puts forward that the application range of administrative coercion removing should be limited in the commonweal construction project and should be restricted by strict program and condition to ensure the relocated people＇s lawful rights.
