摘　　要：由于《城乡规划法》本身"重实体,轻程序"的特点,在涉及程序的约束与限制方面还存在不足.从操作层次和法理支持两方面看,《行政程序法》在规范和限制政府行政权力方面能够发挥较大作用.Due to the characteristics of ＂concerns the matter and neglects the process＂ in the ＂Town and Country Planning Act＂, there is a lot of loopholes and weaknesses in the procedure evolved with the constraint and restriction. The ＂Administrative Procedure Act＂ is a procedural law, mainly to regulate and restrict the administrative power. In terms of operation or legal support, it exerts much greater effect and influence on the town planning process than ＂Town and Country Planning Act＂.
