论经营者集中的反垄断法问题

摘　　要：经营者集中对市场经济的发展有着积极促进与消极妨碍双重作用,这就要求在对其进行法律调控时必须用辩证的观点对其进行正确的分析与研究,本文通过阐述经营者集中与垄断的关系,明确对经营者集中进行规制的必要性。通过科学的立法,客观地反映经济发展对经营者集中的要求,既要允许企业适度合并,充分发挥其规模经济效益等积极功能,又要防止经营者集中过度发展,导致垄断,从而破坏公平竞争。Concentrated operators have stimulative and preventive dual functions to the development of market economy, which demanding we should use dialectical unity thoughts to analyze it when regulate and control it with law. The paper through the elaboration on the relationship between concentrated operators and monopoly to appears the demand of economic development to concentrating operators objectively. We must not only promise the suitable merge of enterprises so that it can unleash scale economy active function and so on, hut also have to prevent the over-development of the operators causing monopoly and breaking fair competition.
