摘　　要：对中药复方专利的侵权如何进行认定,一直是司法实践的难题和人们争论的焦点,存在着比例说,有效部分说等等不同观点。新中药复方在现有的中药复方专利基础上进行的药量加减、药味的部分替换或全部替换,如果能在显著提高疗效、减少毒副作用、作用新的部位、适应新的病症、作用同一病症的不同类型等任何一方面有所突破,就应当认定该复方对中药领域的普通技术人员来说具有"非显而易见性",有突出的实质性特点和显著的进步,具有创造性,不构成对现有中药复方专利的侵权,反之,则应该认为存在侵权行为。How to identify the infringement of the compound patent of the traditional Chinese medicine has been a problem in judicial practice and a controversial point in public debate with different views such as the ratio argument and the effectiveness part argument. The new traditional Chinese medicine compounds, which are based on existing compound patent of the traditional Chinese medicine, carry out the dosage of addition and subtraction, some or all of the replacement of traditional Chinese medicine compounds. If they have any one breakthrough in notable improving curative effects, cutting down the poisonous side effects, working new locations, adapting to the new illness, working different kinds of the same illness., should and so on , they ought to be considered, as afar as ordinary technicians in the field are concerned, to be ＂not noticeable＂ , to have dramatically substantial characteristic with notable progress and innovation of their own and should not be regarded as constituting the patent infringement of compound patent of the existing traditional Chinese medicine.（ ju n che n zuo shi refer to four rankings in the government of the past in China, implying the curing effects of each medicine as indicated by the importance represented by the ranking, jun equivalent to the emperor and then the minister and the point is they should be used in a well-coordinated manner to achieve the best effect..）
