摘 要:从物尽其用原则出发,土地承包经营权应当可以自由转让,但是我国的土地承包经营权带着天然的公有制的烙印,难以表现为完全意义上的民法财产权,所以转让应该受到一定的限制。因此赋予发包人同意权,允许其介入土地承包经营权转让过程,无疑是一种可取的选择。但由于相关法律对同意权行使的规制存在诸多的缺陷,导致了在土地承包经营权的转让过程中,容易发生混乱,因而有必要予以完善。From the principle of making the best use of things, contractual operation right of land is supposed to be exchanged allodially. However,the contractual operation right of land in our country naturally has the inherent feature of public ownership and the right is hard to be expressed as the completed property rights in civil law,thus,it can not be exchanged allodially and also should have some certain limits. There is no doubt that it is an advisable option if we vest the approval right to the party who issues the contract and grant him to get involved in the exchange process of contractual operation of land. Unfortunately, there are many shortcomings on the regulations to exercise the approval rights in the interrelated laws, these shortcomings result in much confusion in the exchange process of contractual operation of land. It is absolutely necessary to perfect theses regulations.
