摘　　要：民族民间文化遗产是特定民族或者世代居住于同一地域的特定群体在长期共同生活和劳动中不断创作、积累而产生的宝贵文化遗产,具有极高的文化、经济和政治价值,亟须对其进行法律保护。其法律保护模式的选择是该领域当今最具争议的问题之一。民族民间文化遗产的特别权利保护模式能够更为充分地体现民族民间文化遗产的保护需求。拟从民族民间文化遗产特别权利保护的内涵、合理性分析入手,对其进行制度的构建提出一些建议。National folk cultural heritage is a particular national or generations living in the same area of the particular groups to live together and work in the long run continuously create,accumulate and produce a valuable cultural heritage,having a very high cultural,economic and political values,the urgent need for them legal protection. Their legal protection mode selection is in the field,one of the most contro-versial issues. National folk cultural heritage,in particular the right to protection mode can be more fully reflect the national folk cultural heritage protection needs. To be from the national folk cultural heritage,in particular protection of the rights of the content and rationality of analyzing the construction of its new systems offer some suggestions.
